Just 48 hours after winning Ecuador’s presidential election, Daniel Noboa has repealed years-old legislation that allowed cannabis, heroin, cocaine and methamphetamine users to carry small amounts of drugs.
Ecuador’s newly-elected president has re-outlawed drug possession just a few days after taking power as part of a campaign promise to crack down on narcotics trafficking.
President Daniel Noboa announced Thursday, less than two days after taking office, that he would be changing the nation’s drug laws to once again make possession of small amounts of drugs a crime, walking back legislation enacted by Democratic Socialist President Rafael Correa’s administration about a decade ago.
Previously, Ecuadorians were permitted to carry up to 10 grams of cannabis, two grams of cocaine paste (the raw materials made from coca leaves used to synthesize cocaine in a lab), one gram of cocaine, 0.10 grams of heroin and 0.04 grams of amphetamine. However, Noboa’s office opted to enact a zero tolerance drug possession policy on the grounds that to permit possession would encourage “microtrafficking.”
“What we promise, we deliver. Through the Ministry of the Interior, I have ordered the repeal of the CONSEP Resolution, thus removing the drug consumption table that encourages microtrafficking,” Noboa’s office said in a translated Facebook post. “In this way, we care for the future of Ecuadorian families and protect our children, girls and adolescents from the use of psychotropic substances and narcotic drugs.”
Narcotics trafficking in Ecuador, mainly cocaine, has been responsible for widespread violence, robberies, murder and kidnappings for years much like some of their other neighboring South American countries. There were over 4,600 deaths related to violence in the country in 2022 alone, according to Al Jazeera. In addition to trying to curb drug trafficking, Noboa also opted to direct his cabinet members to create programs that would offer rehabilitation help to habitual users and to additionally develop “coordinated information, prevention and control programs on the consumption of narcotic and psychotropic substances.”
The original drug possession laws made in 2013 were made to address what President Correa’s administration characterized as a public health crisis with respect to drug use. Correa directed the courts to somehow distinguish between people who were trafficking and people who were simply using drugs, hence the small possession limits. It was not immediately clear how Noboa’s administration would differentiate between traffickers and users, if at all. His predecessor, Guillermo Lasso, announced that he was going to repeal the laws in 2021 but never followed through.
In a previous Facebook post on the day Noboa took office, Noboa announced that the “Drug Board,” which was the term used for the reference table of allowable drugs and possession limits, was on its way out signifying the end of legal drug possession in the country. He symbolized this by ripping up a piece of paper in a Facebook video.
“Today the Drug Board is leaving! For our children, for our young people, for our families, for our country,” Noboa’s post said. “The New Ecuador is already here.”
Noboa defeated a protégée of Correa, Luisa Gonzalez, in the general election on October 15. Noboa will remain in office until May 2025. He is not serving a full term as president because he was elected to finish President Lasso’s appointment. President Lasso stepped down in lieu of having impeachment proceedings take place against him.
Violence soared in Ecuador during Lasso’s term as president. The violent murder rate nearly doubled during Lasso’s short reign as president, even to the point of presidential candidates opting to wear bulletproof vests while campaigning.
“The Mission takes note that presidential candidates have had to resort to wearing bulletproof vests in order to campaign, a fact that limits their ability to move and express themselves in public spaces,” said members of the Organization of American States in a statement earlier this year. “The Mission reiterates its concern about the alarming climate of violence that has overshadowed the electoral campaign in Ecuador.”
Noboa’s term as president also kicked off with the announcement of his presidential cabinet on Thursday, which his administration touted as being composed of almost all women and young people. It would appear Noboa is taking a somewhat radical approach to leading a country that has been awash with violence and corruption for several preceding leadership terms.
“I want to thank my initial work team who helped me bring together all these people with special qualities. They all have the courage, the conviction, the strength to serve the country at its worst possible moment. That is not easy, that requires an additional degree of patriotism and empathy towards the Ecuadorian people.”
Cannabis in Ecuador is illegal for personal recreational consumption as of November 24, 2023. Previously amounts up to 10 grams were allowed, however President Noboa repealed the act allowing possession as part of a campaign promise designed to reduce “micro trafficking”.
Cannabis for medical purposes was legalized by the National Assembly of Ecuador in September 2019 by an 83 to 23 vote. It is unclear as to whether this has changed due to removal of the Ecuadorian Drug Table.

Punishment for personal consumption is unclear as of November 24th 2023, it is however now illegal (recreationally) in any amount.
・Laws on Selling Marijuana(マリファナ販売に関する法律)

Law 108 of 1991 imposed a ten-year jail sentence. However, the application of the law has remained the same. For example, if someone is charged with other marijuana-related offenses, such as murder or drug trafficking, they may still face up to 25 years in prison.
・Laws on Cannabis Cultivation(大麻栽培に関する法律)
Cannabis cultivation is not commonly practiced in Ecuador. It is mostly a transit nation. As a result, the number of marijuana cultivators is significantly lower than in other South American nations.
Cannabis production is only permitted in Ecuador for personal use.
However, in the prosecution's view, everyone who grows plants for his use is not a criminal, Where CBD is currently legal in Ecuador.
In Ecuador, recreational cannabis use is illegal due to recent legislative changes, while medical cannabis, legalized in 2019, faces ambiguous regulations amidst growing public advocacy for decriminalization and legalization. ■Historical Overview of Cannabis Regulation in Ecuador(エクアドルの大麻規制の歴史的概要)
Significant shifts have marked Ecuador’s journey with cannabis regulation. Initially, the nation had some of the harshest drug laws in South America, leading to severe prison overcrowding. This was primarily due to the lack of distinction between minor users and major traffickers. In response to criticism from human rights groups, 2013 saw a pivotal change: the decriminalization of personal cannabis use up to 10 grams and the allowance of limited home cultivation. This reform aimed to differentiate casual users from serious offenders. However, the sale and distribution of cannabis remained strictly illegal, with harsh penalties for offenders. )
Ecuador’s role as a transit country in the international drug trade has also influenced its cannabis policies. The nation’s unique geographical and cultural landscape has shaped its approach to cannabis regulation, balancing international pressures with domestic concerns.
■Medical Cannabis in Ecuador: Legal Provisions and Accessibility(エクアドルの医療大麻:法的規定とアクセシビリティ)
The legalization of medical cannabis in Ecuador in 2019 marked a significant milestone in the country’s drug policy. However, the transition from legislation to practical application has been complex and challenging. The legal framework for accessing medical cannabis is not fully established, leading to ambiguities and difficulties for patients. Questions remain about prescription processes, distribution channels, and the range of available cannabis-based products. Despite the legalization, many patients face hurdles in obtaining medical cannabis, including a lack of clear guidelines and potential bureaucratic obstacles. The situation is further complicated by the ongoing debate over the legal status of CBD and its use in medical treatments. As Ecuador navigates these challenges, the effectiveness of its medical cannabis program continues to evolve, reflecting broader trends in global drug policy reform.
■Current Legal Status of Recreational Marijuana in Ecuador(エクアドルにおける娯楽用マリファナの現在の法的地位)
Recreational cannabis in Ecuador is illegal, with the law undergoing significant changes in recent years. The country had previously decriminalized the possession of small amounts for personal use, but this policy was reversed in 2023. The current legal status is ambiguous, especially regarding possession and consumption penalties. Law enforcement practices vary, and the decision to charge individuals is often left to officers’ discretion. This lack of clarity has sparked public debate and calls for more transparent and consistent regulations. )
The situation is indicative of a broader struggle within Ecuador to balance public health concerns, law enforcement priorities, and changing societal attitudes towards cannabis. As the global conversation around cannabis legalization evolves, Ecuador’s approach to recreational cannabis remains a topic of keen interest and potential change.
■Possession, Cultivation, and Consumption: What’s Allowed in Ecuador? )
While the cultivation of cannabis for personal use was decriminalized, allowing individuals to grow a limited number of plants at home, the sale and large-scale cultivation remain illegal. The penalties for these offenses are severe. The legal status of CBD is also a subject of ongoing debate, with discussions about its potential legalization for medicinal purposes. The possession and use of recreational cannabis, which were previously decriminalized for small amounts, are now illegal following recent legislative changes. This has led to a situation where the legal landscape is marked by inconsistencies and enforcement that varies by region and circumstance. The laws reflect Ecuador’s cautious approach to cannabis, balancing drug control with emerging trends in public opinion and global drug policy.
